I wouldn't bet on that. Nothing would be worse for MS than to
*try* a high-visibility prosecution and then somehow *lose*, thereby
setting a *huge* precedent against their position.
This is the same reason that many folks on both side of the
abortion issue don't touch certain things with a 10-foot pole, because
they're afraid to set a precedent against their position (i.e. "fetal
murder" cases scare the hell out of both sides).
